Terms & Conditions

Effective August 1, 2023:
The Mountain Bureau LLC (MB) has created policies that strive to be fair to all parties. By making any payment you agree to the following terms and conditions. With enough notice, a trip can be canceled and a refund can be issued minus administrative fees, logistical fees, or fees associated with the reservation that have already been incurred. As the trip or course start date draws near, guides have committed to the trip and thus trip or course fees go to compensate the professionals that have set aside time to run your trip. In certain circumstances, we will attempt to accommodate changes and cancellations, waiving fees at our discretion. The Mountain Bureau strongly suggests that participants purchase trip cancellation insurance within 20 days of their initial reservation, to protect against the loss of program fees and related travel expenses. The Mountain Bureau LLC Terms and Conditions are as follows:

 

YOUR COMMITMENT WHEN BOOKING WITH US

  • By registering for a MB trip or course and making a payment, you agree to the Terms and Conditions of Mountain Bureau LLC. Additionally, you certify that you are fully capable of participating in this activity you are registering for (see “PERSONAL RESPONSIBILITY” below).

  • For domestic programs, the full balance of your program fee is due 30 days prior to your program start date. For international programs, the full balance of your program fee is due 60 days prior to your program start date. Failure to complete full program payment by these times will result in the cancellation of the program. No refunds or credits will be issued for cancellations due to failure to complete payment.  

  • For selected products and products valued at $400.00 USD and over, your registration will include an option to pay a minimum 25% installment of the total program value, with opportunities to make additional installments at your discretion, the balance of all program fees are due a minimum of 30 days prior to your program start date. By making an installment payment, you agree to have the remaining balance of your program automatically collected 30 days prior to the start date of your program, using the payment method we have on file.

  • Individuals making reservations for a group are responsible for the entire program cost, including deposits, installment payments, and final payments.

  • Should you refuse to agree to the Mountain Bureau Acknowledgement of Risk Form associated with your program, you will be excluded from trip or course participation and any associated program fees will be subject to the “Cancellations and Refunds” portion of these Terms and Conditions.

  • By registering for a MB trip or course, you agree to abide by the timelines set by The Mountain Bureau and your guide. Participants arriving late to predetermined team meetings and or locations may be excluded from program activities. This determination is at the sole discretion of the guide. In the event of your timeliness affecting the outcome of a program, you may be excluded from the program and will not receive a refund. No refunds will be given for early departure from a MB trip or course.


CANCELLATIONS AND REFUNDS

WHEN A CLIENT REQUESTS TO RESCHEDULE OR CANCELS THE TRIP

  • Requests for rescheduling or canceling a trip or course must be made in writing and be received by MB at least 30 days before the program begins.

  • Cancellations requested within 24 hours of booking are eligible for a Full Refund minus booking or merchant processing fees.

Domestic Trips/Courses (Within the Contiguous United States):

  • Decisions on rescheduling a trip will be at the sole discretion of the Mountain Bureau LLC. A change fee of up to 15% may be assessed on any rescheduled program. No refunds or credits will be issued if the new program is less expensive than the original.

  • If you cancel a trip 60 days or more before the program start date, 90% of the retail price of your trip will be refunded.

  • If you cancel a trip 30 days or more before the program start date, 50% of the retail price of your trip will be refunded.

  • No refunds will be provided for cancellations made within 30 days of the program start date.

  • Reservations that have not received final payment and are within 30 days of the program start dates will be canceled and no refunds or credits will be provided.

  • No refunds or credits will be provided for booking or merchant processing fees.

International Trips/Courses (Outside the Contiguous United States):

  • Decisions on rescheduling a trip will be at the sole discretion of the Mountain Bureau LLC. A change fee of up to 15% may be assessed on any rescheduled program. No refunds or credits will be issued if the new program is less expensive than the original. 

  • If you request to cancel a trip 90 days or more before the program start date, 90% of the retail price of your trip will be refunded.

  • If you request to cancel a trip 60 days or more before the program start date, 75% of the retail price of your trip will be refunded.

  • No refunds will be provided for cancellations made within 60 days of the program start date.

  • Reservations that have not received final payment and are within 60 days of the program start dates will be canceled and no refunds or credits will be provided.

  • No refunds or credits will be provided for booking or merchant processing fees.

WHEN THE MOUNTAIN BUREAU LLC CANCELS THE TRIP

  • In the event that The Mountain Bureau LLC chooses to can­cel a trip due to insufficient participants or rea­sons within our con­trol, you will receive a full refund. Mountain Bureau LLC is not responsible for and will not provide refunds, credits, or reimbursements for expens­es incurred by the participant, including but not limited to airfare, equipment, or lodging. For this rea­son, we strongly suggest that participants purchase trip cancellation insurance to protect against the loss of program related expenses.

  • In the event that The Mountain Bureau LLC must cancel a trip due to circumstances beyond our control, such as acts of man (e.g. travel restrictions, war, terrorism, etc.), forces of nature (e.g. earthquakes, severe storms, wildfires, etc.), and in situations regarding participant and guide safety, you will receive a full account credit to be applied to a trip or course rescheduled within 60-days. Mountain Bureau LLC is not responsible for and will not provide refunds, credits, or reimbursements for expens­es incurred by the participant, including but not limited to airfare, equipment, or lodging. For this rea­son, we strongly suggest that participants purchase trip cancellation insurance to protect against the loss of program related expenses.

SPECIAL CONSIDERATIONS FOR DISCOUNTED TRIPS, CLINICS, AND EVENTS ASSOCIATED WITH FESTIVALS

  • "SPECIAL CONSIDERATIONS FOR DISCOUNTED TRIPS, CLINICS, AND EVENTS ASSOCIATED WITH FESTIVALS" applies to any Mountain Bureau LLC promotional program offered under a headlining event with "fest" or "festival" in its name, including but not limited to Index Climbers Festival, Mazama Rock Fest, and Cascadia Splitfest.

  • Cancellations requested within 24 hours of booking are eligible for a Full Refund minus booking or merchant processing fees.

  • No refunds, credits, or rebookings will be provided for cancellations, under any circumstances, after 24 hours from the original booking.


GENERAL POLICIES

PERSONAL RESPONSIBILITY

By registering for a MB trip or course and making a payment, you certify that you are fully capable of participating in this activity you are registering for. Therefore, you assume full responsibility for yourself and any participating minors, for bodily injury, death, and loss of personal property or expenses as a result of the inherent risks and dangers of this activity or of your negligence in participating in this activity. Information on the nature and physical demands of this activity including the risks, hazards, and dangers associated with it is available to you by contacting our office at contact@mountainbureau.com. It is your responsibility to continue to self-assess throughout the activity to ensure safe participation is possible. You must honestly and accurately describe yourself, in terms of fitness, health, skills, and your equipment, to your guides. In all circumstances, you agree to adhere to the instructions of your guide.

PARTICIPATION RISK RELATIVE TO INFECTIOUS DISEASE

By registering for a MB trip or course and making a payment, you agree to follow the advice and risk management techniques regarding the risk of transmission to known infectious diseases and you assume the risks of a potential exposure. You understand that the risk of transmission of an infectious disease can never be fully eliminated on our programs.

ALL PRODUCTS ARE ATTEMPTS

The Mountain Bureau cannot guarantee that you will reach the summit or complete your program. Weather, route conditions, participant abilities, safety or logistical concerns may create circumstances that make a program unsafe or unattainable. You or your entire party may have to turn around without reaching the goal. This determination is at the sole discretion of the guide and no refunds will be given for programs that end early.

UNFORTUNATE EXPENSES 

You understand the possibility of events occurring that may cause additional costs that are unforeseen at this time. A disruption could be related to, but are not limited to, rescue or evacuation, layovers, airline change fees or purchasing of tickets, natural disasters not allowing travel, new routes of transportation, experiencing theft, medical treatment or prescriptions, medical transport, loss of passport or other personal documents, loss or delayed luggage, political unrest, terrorism, or a pandemic. It is not the responsibility of Mountain Bureau LLC to compensate participant(s) for these or other unexpected expenses. Mountain Bureau LLC strongly encourages participants to purchase travel insurance to help with any unforeseen expenses during your trip.

PHOTOGRAPHIC RELEASE 

By making a payment, you agree to allow The Mountain Bureau LLC to take photographs or recordings of any Mountain Bureau LLC tour, program, or activity. Each trip member hereby agrees that Mountain Bureau LLC may use such photographs or recordings for promotional and/or commercial purposes.

LOCATION OF FILE

By making payment, you agree that these policies remain in full force and effect. In the event that you file a lawsuit against Mountain Bureau LLC, you agree to do so solely in the state of Washington in the United States of America, and you further agree that the substantive law of that state shall apply in that action without regard to the conflict of law rules of that state.


MOUNTAIN BUREAU LLC GIFT CERTIFICATES AND GIFT CARDS

MOUNTAIN BUREAU TERMS & CONDITIONS SUPPLEMENT - Effective Nov. 1, 2022

By purchasing or using a gift certificate or gift card (including electronic gift codes) (“Gift Certificate”) issued by Mountain Bureau LLC (“The Mountain Bureau”), you agree to these terms and conditions (“Gift Certificate Terms”). Gift Certificates are redeemable for eligible purchases only on the website of mountainbureau.com (“Services”). To redeem a Gift Certificate, you must create or have an existing and valid account to access our Services.

These Gift Certificate Terms supplement and are part of the Mountain Bureau LLC Terms and Conditions, which apply to any use of the Services. Any disputes arising from these Gift Certificate Terms, including any purchase or use of Gift Certificates or Gift Cards, will be subject to the limitations of liability, governing law and dispute resolution procedures specified in the Terms and Conditions.

Gift Certificates are not refundable (whether for cash or otherwise) and cannot be redeemed for cash, except to the extent required by applicable law. Gift Certificates cannot be used to purchase other Gift Certificates, and cannot be reloaded, resold, or transferred for value. For combinations with other offers, restrictions may apply. Unless purchased as part of limited engagement activities (Backcountry Ski Pass), Gift Certificates do not expire and are not subject to any transaction or dormancy fees. We reserve the right to cancel a purchased Gift Certificate if we suspect that it has been obtained or used unlawfully or otherwise in violation of these Gift Certificate Terms or the Terms of Use.

Title to the Gift Certificates and the risk of loss, destruction or deterioration pass to the purchaser upon purchase. Mountain Bureau LLC is not responsible for any Gift Certificates that are lost, stolen, destroyed or used without your permission. IN THE EVENT A GIFT CERTIFICATE IS NON-FUNCTIONAL, YOUR SOLE REMEDY, AND OUR SOLE LIABILITY, WILL BE THE REPLACEMENT OF SUCH GIFT CERTIFICATE.

Gift Certificates are issued by Mountain Bureau LLC, a Washington limited liability company. The laws of the State of Washington, without regard to principles of conflict of laws, will govern these Gift Certificate Terms. If there is a conflict between these Gift Certificate Terms and our Terms and Conditions, these Gift Certificate Terms will control only to the extent of the conflict. If any provision or part of a provision of these Gift Certificate Terms is unlawful, void or unenforceable, that provision or part of the provision is deemed severable from these Gift Certificate Terms and does not affect the validity and enforceability of any remaining provisions.

Mountain Bureau LLC may modify these Gift Certificate Terms from time to time. If we make changes, we will provide notice of such changes, such as by sending an email notification, providing notice through our Services, or posting the amended Gift Certificate Terms to our Services and updating the “Effective” date above. Unless we say otherwise in our notice, the amended Terms will be effective immediately and will apply to any use or purchase of Gift Certificates on or after the Last Updated date.
